Terms of Purchase & The Safe Passage Protocol
At Ginny Garden, every order begins with a conversation. Whether we are sending a specimen across Bangkok or across the globe, shipping living art requires precision, trust, and a shared understanding of the natural world. By confirming your order and submitting payment, you agree to the following protocols, designed to protect both the plant and our partnership.
1. The Safe Passage Protocol
We guarantee that every plant leaves our sanctuary in peak health, having undergone a strict pre-departure evaluation by Win and Benz.
For Domestic Collectors (Thailand): Plants are meticulously secured for local transit via Grab (Same-Day), Thai Post EMS, or Kerry Express, ensuring optimal stability for the short journey to your door.
For Global Collectors: To comply with international regulations, roots are stabilized in a soil-free state using specialized media, and foliage is secured in custom, breathable wrapping. We assume full responsibility for securing the Phytosanitary Certificate from the Thai Department of Agriculture (DOA) to ensure legal export clearance.
2. Transit Risk & "Botanical Jet Lag"
Once a package is handed over to our delivery partners, the liability and risk of transit transfer to the buyer. Travel is a significant transition. You acknowledge that Botanical Jet Lag—including yellowing foliage, dropped leaves, or root stress—is a natural part of the acclimation process. Cosmetic transit stress does not constitute a damaged or dead plant. We guarantee the health of the core node and root system upon dispatch, but we cannot be held responsible for uncontrollable carrier delays or extreme weather.
3. The Live Arrival Promise & Claims
We define Live Arrival strictly as a plant delivered with a healthy, viable stem and root system capable of resuming growth.
The Claim Process: In the rare event a resident does not meet this standard, you must contact us within 24 hours of delivery. You are required to provide a continuous, unedited unboxing video to allow us to accurately assess the plant's condition.
Resolution: We treat our collectors as partners. If the plant fails to meet our Live Arrival standard, we will work with you directly to provide expert recovery guidance or negotiate a fair and reasonable solution based on the specific circumstances.
4. International Customs & Import Permits
For our global collectors, it is your sole responsibility to verify your local import regulations before placing an order.
If your country requires an Import Permit, you must provide it to us before the box leaves Bangkok.
Ginny Garden cannot be held liable for packages that are delayed, opened, confiscated, or destroyed by your local customs authority due to missing buyer-side permits, unpaid duties, or sudden changes in local agricultural policy. In these events, the Live Arrival Promise is voided.
5. Payment & Finality of Sale
Because our specimens are living organisms that undergo stress during transit, they cannot survive two-way shipping. Therefore, once payment is received, all sales are final. We do not accept returns, exchanges, or cancellations.
6. Natural Variation
While we provide fresh photos and videos of your specific plant prior to payment, living art continues to grow and change daily. Your plant will possess its own unique venation, coloration, and character, which will continue to evolve as it matures in your specific environment.
