At Ginny Garden, we respect your privacy as much as we respect the cultivation process. Our policy is simple: we only collect the information that is strictly necessary to communicate with you and deliver our plants safely to your door. We do not sell, trade, or misuse your personal data. This policy transparently explains how we handle your information in full compliance with the Thai Personal Data Protection Act (PDPA).

1. Information We Collect & Why

We only collect personal information when you place an order, request an appointment, or contact us directly. This information is limited to your Full Name, Shipping and Billing Address, Email Address, Phone Number, and Payment Information (processed securely via our third-party payment gateways; Ginny Garden does not store your credit card details). We use this data to process your payment, provide shipping updates, and respond to your direct inquiries. Because this information is strictly necessary to fulfill your order, we unfortunately cannot ship your plant if you do not provide it.

For international orders, we may also ask for your customs ID (like an EORI number or National Tax ID). We only collect this when your local customs office strictly requires it to clear your plant through border control. Lastly, we collect digital footprints like IP addresses to improve our website, but we will always ask for your consent before using any non-essential cookies.

2. Logistics & Global Partners

Global shipping requires trusted partners. We only share your necessary details with our designated shipping carriers and government agricultural departments to secure mandatory export and import certifications. To get your plant to you safely and without border delays, we must submit your delivery details to secure, paperless government portals (such as the Thai ePhyto network and the EU’s TRACES NT system). Since this involves transferring your data across borders, we rely on legal safeguards like Standard Contractual Clauses (SCCs) to ensure your data remains fiercely protected under Thai law.

3. Data Retention

We retain your general order information for our internal business and tax records, and we delete it when it is no longer needed. However, because plants are living organisms, international agricultural laws require us to securely archive your official shipping papers (like Phytosanitary Certificates and customs declarations) for a specific timeframe. We hold onto these documents to help global authorities trace and prevent the spread of plant diseases.

4. Your Privacy Rights

You maintain full control over your personal data. At any time, you may contact us to request to view, update, move, or permanently delete the personal information we have on file for you. You also have the right to withdraw your cookie consent, object to certain processing, or file a formal grievance with the Personal Data Protection Committee (PDPC). Please note that if you request deletion, we may be legally required to hold onto your official shipping documents for a set period to comply with agricultural safety laws.
